1. Acceptance of Terms
By accessing or using SendKard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. SendKard is operated from Cambodia and these terms are governed by Cambodian law.
2. Eligibility
You must be at least 13 years old to use SendKard. By using the Service, you confirm that you meet this requirement. If you are under 18, you should have parental or guardian consent.
3. Your Account
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when registering.
- You may not share your account with others or use another person's account.
- Notify us immediately if you suspect unauthorised access to your account.
4. Pricing & Plans
SendKard offers the following plans:
- Free — your first event is free, one time only. Includes full access to the builder, all templates, unlimited guests, unlimited photo uploads, QR payment section, background music upload, and bilingual (Khmer/English) fields.
- Pay per event — $8.99 USD — a one-time purchase per additional event, with the same full access as the Free plan. No subscription or recurring commitment.
- Subscription — $14.99 USD/month or $89.99 USD/year — unlimited event creation while your subscription is active, plus access to saved contacts and RSVP history across events. Automatically renews each billing cycle until cancelled.
All plans, free and paid, display a "Lovingly made with SendKard" attribution on the invitation page. This is not removable on any plan.
We may change our pricing at any time. Changes will not affect events you have already created or purchased, but will apply to new purchases or renewals going forward.
5. Payments
- Payments may be made via the payment methods available on the Service at the time of purchase (e.g. QR-based local payment, third-party payment processor).
- For payment methods requiring manual verification, you must provide accurate transaction details (such as a transaction reference number and amount). Submitting false or misleading payment information may result in account suspension and forfeiture of access to the associated event.
- Subscription plans renew automatically at the end of each billing cycle unless cancelled beforehand. It is your responsibility to cancel before renewal if you no longer wish to continue.
6. Refund Policy
One-time event purchases and subscription payments are eligible for a refund only under specific conditions. See our full Refund Policy for details on eligibility and how to request one. You may cancel a subscription at any time to stop future renewals; see Section 8 for what happens to your events after cancellation.
7. Event Editing Rules
To keep the Service fair and prevent misuse, the following rules apply to every event you create, regardless of plan:
- Event type (e.g. wedding, birthday, house-warming) is set when you create the event and cannot be changed afterward.
- Event date may be edited freely before the event date, and for 14 days after the event date has passed. After this 14-day window, the event date can no longer be changed.
- All other event content — names, venue, message, photos, template, thank-you notes, and other event details — may continue to be edited at any time, with no restriction.
- Deleting an event does not restore or refund any credit (free or paid) that was used to create it.
8. Subscription Cancellation & Events Created Under a Subscription
If your subscription is cancelled (by you) or lapses (due to a failed or declined payment):
- Events you created while subscribed remain fully editable for 14 days from the date of cancellation or the failed payment, whichever applies.
- After this 14-day period, those events become view-only — your guests can still view the invitation and submit RSVPs as normal, but you will not be able to make further edits unless you resubscribe, your payment succeeds, or you purchase individual access to that event for $8.99.
- This does not affect your guests' ability to view or RSVP to already-published events at any time.
9. Acceptable Use
You agree not to use SendKard to:
- Send spam, unsolicited messages, or misleading invitations.
- Upload content that is unlawful, harmful, defamatory, or infringing.
- Impersonate another person or entity.
- Attempt to gain unauthorised access to any part of the Service.
- Submit false payment information or attempt to circumvent the Service's pricing or plan rules.
- Use automated tools, bots, or scripts to submit RSVPs or interact with the Service.
- Use the Service for any illegal purpose under Cambodian or applicable law.
We reserve the right to suspend or terminate accounts found to be violating these rules, including revoking access to events created through fraudulent or abusive activity.
10. QR Payment Feature
SendKard allows hosts to upload their own QR payment code (e.g. for receiving wedding gifts) for display on their invitation page. SendKard:
- Does not process, verify, or have any involvement in payments made by guests via a host-uploaded QR code.
- Is not responsible or liable for the accuracy of the QR code uploaded, any payments sent to it, or any disputes arising between hosts and guests regarding such payments.
- The host is solely responsible for ensuring the QR code they upload is accurate and belongs to them.
11. Your Content
You retain ownership of the content you create on SendKard (invitations, images, audio, event details). By uploading content, you grant SendKard a limited licence to store, display, and share it as necessary to operate the Service (e.g. showing your invitation to guests via a shared link).
12. Service Availability
We strive to keep SendKard available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or suspend the Service without prior notice. We are not liable for any loss resulting from downtime.
13. Intellectual Property
All trademarks, logos, and software of SendKard are our property. You may not copy, modify, or distribute any part of the Service without our written permission.
14. Limitation of Liability
To the fullest extent permitted by law, SendKard is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or revenue.
15. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may also delete your account at any time. Upon termination, your content may be deleted from our systems, subject to Section 5 of our Privacy Policy regarding data retention.
16. Changes to Terms
We may update these Terms from time to time. We will notify you by updating the date above. Continued use of the Service after changes constitutes acceptance of the new Terms.
